General Information

The Louisiana Clerks' of Court Retirement and Relief Fund, La. R. S. 11:1502 was established by Act 1950, Paragraphs 1 and 4. The body of its laws is now contained in La. R. S. 11: 1501 through La. R.. S. 11:1563 with some general references in La. R. S. 11:131 et seq. It is administered and managed by the board of trustees for the purpose of providing regular, disability and survivor benefits for clerks of court, their deputies and other employees, and the beneficiaries of such clerks of court, their deputies, and other employees. In 2009, it services approximately 900 retirees and over 2,400 active members.

"Membership" La. R. S. 11: 1511 is defined as "the clerks of the supreme court, each of the courts of appeal, each of the district courts, and each of the city and traffic courts in cities having a population in excess of four hundred thousand, and the employees of such clerks, whether full-time or part-time (at least twenty (20) hours per week) and the employees of the Louisiana Clerks of Court Association, the Louisiana Clerks' of Court Retirement and Relief Fund, and the Louisiana Clerks of Court Insurance Fund, shall be a member of the system during service as such." "Membership in the system ceases when a member resigns, is dismissed, retires, or is otherwise separated from service as a clerk or employee."

Any person who shall knowingly make any false statement or shall falsify or permit to be falsified any record or records of this system in an attempt to defraud the system shall be guilty of a misdemeanor and, or conviction thereof by any court of competent jurisdiction shall be punished by a fine not to exceed one thousand dollars or imprisonment in the parish jail not to exceed twelve months, such fine and imprisonment at the discretion of the court.

  Active Member Information

"Employee" means any deputy clerk, minute clerk, or other regular employee of a clerk or any employee of the Louisiana Clerks of Court Association, the Louisiana Clerks' Retirement and Relief Fund, and the Louisiana Clerks of Court Insurance Fund, who works more than an average of twenty hours (20) per week.

A member shall receive credit for all service rendered as a member of the system for which the required contributions have been paid and not withdrawn.

If a member who is not eligible to retire is terminated, the former member may apply for and obtain a refund of their accumulated employee contributions. However, no refund shall be paid until the information on the
Request for Refund application has been verified and certified by the clerk for whom the former member was employed and the former member remains out of service for sixty days and until all contributions for said member have been paid into the fund. Payment of such a refund to the former member cancels all rights in the fund.

If a former member who had withdrawn their accumulated employee contributions again becomes a member of the fund, they may repay to the fund in a lump sum the amount they withdrew plus compounded interest at the rate of eight percent (8%) per year computed from the date of withdrawal. Upon such repayment, the member shall be credited for all service which was cancelled and forfeited at the time of the prior refund and all rights shall be restored. Membership Information

A member or former member shall be eligible for regular retirement benefits if they have twelve or more years of credited service, have attained the age of fifty-five (55) years or more, and have terminated their employment. A member who becomes disabled and who files for disability benefits while in service, and who upon medical examination and certification as provided for below, is found to be totally disabled (a) solely as the result of injuries sustained in the performance of their official duties, or (b) for any cause provided the member has at least ten (10) years of creditable service and provided that the disability was incurred while the member was an active contributing member in active service, shall be entitled to disability benefits.

The Retirement System established a Deferred Retirement Option Program (DROP) in 1993
(La. R. S. 11:1530). Members must be one year past the eligible age for retirement (age 55) with at least twelve (12) years of service. The participant may remain in the DROP a maximum of three (3) years. The program does maintain an option to return to work at that time.
